BOOKING TERMS

 

This contractual document will govern the booking of accommodations through the website https://www.hqlagaleria.com owned by Hostelería Quintanadueñas S. L., under the trade name HQ LA GALERIA, hereinafter referred to as the Provider, whose contact details are also included in this Website’s Legal Notice.

These Terms will remain published on the website for the user to reproduce and save as confirmation of the contract, and may be modified at any time by the Provider. It is the user’s responsibility to read them periodically, as those in effect at the time of placing orders will apply.

The contract will not be subject to any formal requirement except as expressly stated in the Civil and Commercial Codes and in this or other special laws.
By accepting this document, the user: Has read, understands and comprehends what is stated herein.
Is a person with sufficient capacity to contract.
Assumes all obligations set forth herein.

These conditions will have an indefinite period of validity and will apply to all bookings made through the Provider’s website.

The Provider informs that the business is responsible for and aware of the legislation in force in the countries to which it offers its services and reserves the right to unilaterally modify the conditions, without affecting the goods or promotions that were booked prior to the modification.

Identity of the contracting parties

On the one hand, the Provider of the accommodation booking service contracted by the user is HQ LA GALERIA, with registered office at Carretera Burgos-Aguilar KM. 4, 09197 Quintanadueñas (Burgos), VAT ID B09353483 and customer/user service phone 947292606.

And on the other hand, the website user, responsible for the truthfulness of the personal data provided to the Provider.

Object of the contract

This contract aims to regulate the contractual relationship between the Provider and the user once the user accepts it during the online booking process for the accommodation and/or room.

This booking contract involves renting the chosen accommodation for a limited time, in exchange for a specified and publicly displayed price on the website. Extra services must be booked at the time of reservation.

Booking procedure

The user, to access the services offered by the Provider, must be of legal age and must freely and voluntarily provide the personal data required, which will be processed in accordance with Regulation (EU) 2016/679 of April 27 (GDPR), and Organic Law 3/2018 of December 5 (LOPDGDD), detailed in the Legal Notice and Privacy Policy of this website.

The Provider informs you that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the booking process will follow these steps:
1.    General booking clauses.

3.   Purchase process.
4.   Price and offer validity period.
5.   Right of withdrawal (cancellations).

1.    GENERAL BOOKING CLAUSES

Unless otherwise explicitly stated in writing, making a booking with the Provider will constitute acceptance of these legal conditions by the user. No stipulation made by the user may differ from those of the Provider unless expressly accepted in advance and in writing by the same.

2.    BOOKING ACTIVATION AND PAYMENTS

The Provider will inform the user in advance about the procedure to follow to make the booking.

The automatic availability and price calculation system allows the user to select the room of interest and use the credit card as a guarantee, with payment made at the establishment.

Security measures

The website uses information security techniques generally accepted in the industry, such as SSL, secure page data entry, firewalls, access control procedures, and cryptographic mechanisms, all aimed at preventing unauthorized access to data. To achieve these purposes, the user agrees that the Provider obtains data for the purposes of corresponding access control authentication.

The Provider commits not to allow any transaction that is or may be considered illegal by credit card brands or the acquiring bank, which may or have the potential to damage their goodwill or negatively influence them.

The following activities are prohibited under card brands’ programs: the sale or offer of a product or service that does not comply with all laws applicable to the Buyer, Issuing Bank, Merchant, or Cardholder.

3.    PURCHASE PROCESS

The website includes a search system by different parameters to facilitate the choice of accommodation and its regime.

Select check-in and check-out dates, occupants (adults and children) and chosen extra services and add to the cart. There, only selected services, quantity, price, and total amount will be displayed. Once the cart is saved, taxes, fees, and discounts will be calculated based on the provided data.

Carts have no administrative linkage; they are only for simulating a quote without commitment from either party.

From the cart, an order can be placed by following the steps below for proper formalization:

1.    - Check billing details.
2.    - Check booking (dates, services...).
3.    - Select payment method.
4.    - Place booking.

Once the order is processed, the system immediately sends an email to the Provider’s management department and another to the user confirming the booking.

Within a maximum of 24 hours on business days, an email will be sent to the user confirming the booking status and all relevant information.

From the Online Booking section, the description and characteristics of the accommodation, included services, optional services (extras), and specific conditions for each room can be consulted.

4.    PRICE AND OFFER VALIDITY PERIOD

The prices indicated for each booking include Value Added Tax (VAT). Unless expressly stated otherwise, these prices do not include tourist taxes, travel insurance, or any other additional or ancillary services.

The prices applicable to each room and meal plan are those published on the website and will be shown in EURO currency. The user acknowledges that the price of certain services may vary in real-time. Prices may change daily until the booking is made.

Any payment made to HQ LA GALERIA entails the issuance of an invoice with consent (Art. 63.3 RD 1/2007) in the user’s name. This invoice will be issued to the user when the rental ends and payment for the booked services is made.

5.    CANCELLATIONS (right of withdrawal)

The conditions and cancellation period will be expressly stated at the time of online booking. In the event of "no-show" or late arrival, the amount of the first night may be charged to your credit card, and the booking will be canceled.

All cancellations must be communicated to the Provider by phone or email at hotel@hqlagaleria.com.

6.    COMPLAINTS AND ONLINE DISPUTE RESOLUTION

Online Dispute Resolution

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free platform for online dispute resolution between the user and HQ LA GALERIA, without the need to resort to courts, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between both parties. This body is neutral and will engage with both parties to reach an agreement and may ultimately suggest and/or impose a resolution to the conflict.

7.    FORCE MAJEURE

Neither party will be liable for any failure due to force majeure. Compliance with the obligation will be delayed until the force majeure ceases.

8.    JURISDICTION

The user may not assign, transfer, or transmit the contracted rights, responsibilities, and obligations.

If any provision of these terms is deemed null or impossible to perform, the validity, legality, and enforceability of the remainder will not be affected or modified in any way.

The User declares having read, knows, and accepts these Terms and Conditions in full.

9.    OFFER GENERALITIES

Details of each booking, such as accommodation and meal plan, are provided to the user in their respective description on the website.

All sales and deliveries made by HQ LA GALERIA will be subject to these Terms and Conditions.

No modification, alteration, or agreement contrary to the Provider’s Commercial Proposal or stated herein will take effect unless expressly agreed in writing by HQ LA GALERIA, in which case such specific agreements will prevail.

Due to ongoing technical advances and service improvements, HQ LA GALERIA reserves the right to modify its specifications regarding the information provided in its advertising, as long as it does not affect the value of the offered services. These modifications will also be valid if, for any reason, the supply of offered services is affected.

10.    DISSOCIATION AND SUSPENSION OR TERMINATION OF THE CONTRACT

If any of these terms and conditions is considered illegal, null, or unenforceable, this condition will be considered separable and will not affect the validity and applicability of any remaining conditions.

The Provider may, without prior notice, suspend or terminate the user’s access to its services, in whole or in part, for any valid reason, including, without limitation, when the user fails to comply with any of the obligations established in this document or any applicable legal provision, license, regulation, directive, code of practice, or usage policy.

When the Provider exercises any of its rights or powers under this Clause, such exercise will not prejudice or affect the exercise of any other right, power, or remedy available to the Provider.

11.    WARRANTIES

The warranty of the services offered will comply with the following articles based on Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws:

Conformity of services with the contract

1.    Unless proven otherwise, services will be deemed to conform with the contract as long as they meet all the requirements listed below, unless, due to circumstances, any of them is not applicable:

a)    They match the description provided by HQ LA GALERIA.
b)    They are fit for the purposes ordinarily intended for services of the same type.
c)    They are suitable for any special use requested by the user, when communicated to HQ LA GALERIA at the time of contract, provided that the service provider accepted that the service is fit for that use.
d)    They present the quality and performance customary for a service of the same type that a customer can reasonably expect, considering its nature and, where applicable, the descriptions of specific characteristics made by HQ LA GALERIA.
e)    HQ LA GALERIA describes the details, characteristics, facilities, and photographs of the rooms.

2.    Non-conformity resulting from a service not performed or provided will be equated to non-conformity of the contract, provided the responsibility lies with HQ LA GALERIA; conversely, when the service not performed or provided is due to the user's negligence or misuse, it will not be considered a failure of HQ LA GALERIA and will be deemed in conformity with the contract terms.

3.    Liability for non-conformity will not apply to defects known or not able to be ignored by the user at the time of contracting or originating from information provided by the user.

Liability of HQ LA GALERIA

The Provider will be liable to the user for any non-conformity existing at the time the room is made available. HQ LA GALERIA recognizes the user's right to repair of the service, replacement, price reduction, and contract termination, in accordance with applicable regulations.
 
12. APPLICABLE LAW AND JURISDICTION

These terms will be governed by and interpreted in accordance with Spanish law where not expressly stated otherwise. HQ LA GALERIA and the user agree to submit any dispute arising from the provision of the services covered by these Terms to the courts and tribunals of the user’s domicile.

If the user is domiciled outside Spain, the Provider and the user expressly waive any other forum, submitting to the Dispute Resolution Body that will act as intermediary between both according to Art. 14.1 of Regulation (EU) 524/2013, without the need to resort to the courts.
